Environment Agency - Illegal Waste Disposal

< Business & Regulatory Crime Info

BT v. RK - Bolton Crown Court.

An allegation that our client, a company, illegally disposed of waste. Matters were pursued to trial before the Crown Court and the jury returned a verdict of not guilty.

H v. PB - Snaresbrook Crown Court.

An extreme example of the prosecution pursuing an individual for a minor environmental related offences.

Our client, PB, had been employed by his brother's company whilst he was a student. His task was to manage the disposal of waste on a particular site. Our client had always performed his duties diligently and had inspected the relevant certificates prior to allowing any vehicle on site that was authorised to carry waste. On one such occasion representatives of the Environment Agency attended and on assessment of the waste pointed out that it did not meet the requirements as issued by the licence and it therefore amounted to an offence of unauthorised disposal of waste. Our client was the only person on site and was prosecuted.

During the life of the case, we made very detailed representations to the prosecution, and on our application to the court, the prosecution had no option but to withdraw the case. The judge noted a not guilty verdict against our client.
