Restraint Order – Breach - Contempt Proceedings

< Restraint Orders Info

York Trading Standards v. M – York Crown Court.

Our client had been served with a restraint order which had the impact of freezing all of his assets and ongoing business/property transactions. The prosecution in this instant alleged that our client had breached his restraint order by dealing with his assets when he was not entitled to do so.

Our client was then pursued for contempt of a court order and the matter was listed before the Judge who made the order. Had the breach been proved our client would have faced an immediate prison sentence. We successfully defended our client and the breach was not proved.
