Restraint Order - Varied to Release Wife's Money & Assets

< Restraint Orders Info

R v. C - An Accountants wife.

Mrs C was the wife of an accountant who had been accused of charities fraud. We did not represent Mr C but were instructed by Mrs C who asked us to assist in the Restraint proceedings.

Mrs C had previously been a nurse and then had left the profession to have two children. She had worked hard all her life and realised that there was a risk that the authorities would seek to recover assets from her because of her husband's wrongdoing. We acted for Mrs C before her husband was charged and provided the police with evidence showing that our client had acquired her interests in the joint assets quite legitimately. This allowed us to make an application, prior to the conclusion of the proceedings, for the division of the assets to take place. This allowed our client to gain her independence (financially) and secure her share of the assets worth £350,000.

Our application also assisted Mrs C's husband (whom we did not represent) when his case was concluded at the following confiscation proceedings. He was relieved that his wife's assets could not be touched as they were now protected because of our involvement.
